1. The service
Memory Tune provides a guided online service for creating personalised songs based on the information you submit. The finished product is supplied as digital content, not as a physical item.
2. Ordering and contract formation
You can browse, generate a preview, and then choose whether to unlock the full song. A contract is formed when your payment is accepted and we confirm your order or begin supply of the paid digital content.
Order confirmation and delivery updates may be sent by email or shown within the service.
3. Price and payment
Prices shown on the website are the prices payable at checkout unless an obvious error has occurred. Payment is currently processed through Stripe. Access to the final downloadable version is only released after payment has been approved or completed in the payment flow.
4. Personalised nature of the product
The quality and relevance of the finished song depend on the accuracy and completeness of the information you provide. You are responsible for checking names, dates, spellings, and story details before confirming your order.
5. Delivery of digital content
The paid song is delivered digitally by link, library access, or email delivery. Keep your confirmation email, WhatsApp number, and access details safe. You should store downloaded files in more than one safe location.
6. Cancellation rights and immediate supply
If you are a UK consumer, distance-selling rules may normally give you a 14-day cancellation period for digital content. However, where you ask us to begin supplying the paid digital content immediately, and you acknowledge that your cancellation right is lost once supply begins, that cancellation right ends at the point supply starts.
This does not affect rights you may have if the digital content is faulty, not as described, or otherwise breaches contract.
7. Consumer rights for digital content
Under UK consumer law, digital content supplied for payment should be of satisfactory quality, fit for purpose where relevant, and as described. If there is a proven problem with the paid digital content itself, remedies may include repair, replacement, or an appropriate price reduction depending on the circumstances.
8. Intellectual property and permitted use
Unless otherwise agreed in writing, songs supplied through Memory Tune are provided for the customer's personal use and gifting context. Commercial exploitation, resale, or reuse as a branded business asset should not be assumed without specific permission.
9. Service limits and support
We will use reasonable care and skill in providing the service. We are not responsible for failures caused by your device, browser settings, internet connection, third-party outages, or incorrect contact details supplied by you. If something technical goes wrong, contact us and we will review the issue.
10. Unfair terms and statutory rights
Nothing in these terms is intended to remove or reduce rights you cannot legally waive under UK consumer law.
